PolishTutor Terms of Use

These Terms of Use ("Terms") are an agreement between you and Linked Labs, LLC ("Linked Labs," "we," "us," or "our") governing your use of the PolishTutor iPhone and Mac applications, Pola tutoring features, and related services (together, "PolishTutor").

By downloading, accessing, purchasing, or using PolishTutor, you agree to these Terms. If you do not agree, do not use PolishTutor.

1. App Store license

The PolishTutor application is licensed through the Apple App Store under Apple's Standard Licensed Application End User License Agreement. These Terms govern the PolishTutor account, tutoring, subscription, cloud voice, synchronization, and other services. If these Terms conflict with Apple's Standard EULA for the application license, Apple's Standard EULA controls for that license.

2. Eligibility

You must be at least 13 years old to create a Pola account. If local law requires you to be older to consent to these Terms or to data processing, you may use PolishTutor only with the permission of a parent or legal guardian. PolishTutor is not intended for children under 13.

3. Pola accounts

You may create a Pola account using Sign in with Apple or Google. You are responsible for protecting access to your device and identity-provider account and for activity performed through your Pola account.

Use the same Pola sign-in provider and provider account on each device when you want progress, entitlement, and voice-minute balances to follow you. An Apple sign-in and a Google sign-in create different Pola accounts unless PolishTutor later offers and you complete an account-linking flow.

You may sign out or delete your Pola account in the app. Deleting a Pola account does not cancel an App Store subscription.

4. Educational and AI-generated content

PolishTutor is an educational practice tool. It does not guarantee fluency, exam results, admission, employment, immigration status, or any other outcome.

Pola uses automated systems that can misunderstand you or produce inaccurate, incomplete, unnatural, or inappropriate output. Verify important language with a qualified teacher or reliable reference. PolishTutor is not a provider of legal, medical, financial, emergency, or other professional advice.

You are responsible for deciding what information to share. Do not use PolishTutor to send highly sensitive information, confidential business material, or information you do not have permission to provide.

5. Acceptable use

You may use PolishTutor only for lawful personal learning purposes. You may not:

• violate law or another person's rights;
• harass, threaten, exploit, or harm another person;
• upload malware or attempt to disrupt or bypass the service;
• probe security, evade usage limits, falsify purchase records, or interfere with account or billing controls;
• extract provider credentials or use PolishTutor as a general-purpose relay to third-party AI services;
• copy, resell, sublicense, scrape, or commercially exploit the service or curriculum except as allowed by applicable law; or
• use automated access methods unless Linked Labs has authorized them in writing.

We may limit or suspend access when reasonably necessary to protect PolishTutor, users, providers, or legal compliance.

6. Free features

PolishTutor may offer a limited selection of lessons, hosted Pola replies, or cloud voice minutes without a paid subscription. Free allowances are promotional, account-specific, nontransferable, have no cash value, and may be changed or discontinued for future use. We will not remove paid access you have already purchased except as permitted by these Terms, Apple rules, or law.

7. PolishTutor Plus subscriptions

PolishTutor Plus provides the benefits shown on the purchase screen, which may include access to the full guided course, future lesson updates, hosted personalized practice, and a monthly cloud voice-minute allowance. The exact price and billing period are displayed by the App Store before purchase.

Subscriptions are billed to your Apple Account, renew automatically unless canceled at least 24 hours before the end of the current period, and may be billed for renewal within 24 hours before the period ends, subject to Apple's current rules. You can manage or cancel a subscription in your Apple Account subscription settings.

If a free trial or introductory offer applies, the purchase screen will show its duration and the price that follows. Unless you cancel before the trial or offer ends, the subscription converts to the displayed paid plan.

Deleting PolishTutor, signing out, or deleting a Pola account does not cancel a subscription. Apple handles billing, cancellations, and refund requests under Apple's policies. Price changes are handled through the App Store and any consent process Apple requires.

8. Cloud voice minutes and top-ups

An active Plus period currently grants the cloud voice-minute allowance displayed at purchase. Included minutes are used before top-up minutes and expire at the end of their applicable subscription period. Unused included minutes do not roll over.

Voice-minute top-ups are consumable App Store purchases. They are added to the Pola account associated with the verified transaction, do not expire under the current product rules, and have no cash value. They cannot be transferred between Pola accounts. Apple's StoreKit does not independently restore consumables; PolishTutor makes the remaining server-recorded top-up balance available on supported devices when you sign into the same Pola account.

Connection setup, session teardown, interruptions, and provider measurement can cause displayed voice time to differ slightly from speaking time. The server-recorded session duration and ledger control the balance. Contact support if you believe a material error occurred.

9. Universal access on iPhone and Mac

Eligible App Store purchases are offered as a universal purchase for supported iPhone and Mac versions. To restore a subscription on another supported device, use the same Apple Account for App Store purchases, sign into the same Pola account, and choose Restore purchases. Progress and remaining top-up balances depend on the Pola account, so using a different Pola sign-in creates a separate learner profile even when the App Store account is the same.

10. Your content and feedback

You retain ownership of text, speech, preferences, and other content you provide. You give Linked Labs a limited, worldwide license to host, transmit, reproduce, and process that content only as needed to provide, secure, support, and improve PolishTutor and to comply with law. This license ends when the content is deleted from our active systems, except for temporary backup copies and lawful retention described in the Privacy Policy.

If you voluntarily provide product feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.

11. Intellectual property

PolishTutor, Pola, the curriculum, visual design, software, trademarks, and service content are owned by Linked Labs or its licensors and are protected by intellectual-property laws. These Terms do not transfer ownership to you.

12. Third-party services

PolishTutor relies on Apple, Google, hosting, speech, communications, and artificial-intelligence providers. Their availability and policies can affect the service. Your use of Apple and Google accounts and the App Store is also subject to their terms. Linked Labs is not responsible for third-party services outside its reasonable control.

13. Service changes and availability

We may update, add, remove, suspend, or discontinue features. We may perform maintenance or impose reasonable usage, safety, or cost limits. We do not promise uninterrupted or error-free service. If we permanently discontinue a paid service, any remedy will be provided as required by applicable law and Apple policies.

14. Termination

You may stop using PolishTutor at any time. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, misuse providers, or fail to pay amounts due through Apple. Where reasonable, we will provide notice and an opportunity to correct the issue.

Sections that by their nature should survive termination remain effective, including ownership, disclaimers, liability limits, and dispute terms.

15. Disclaimers

To the fullest extent permitted by law, PolishTutor is provided "as is" and "as available." Linked Labs disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and noninfringement. Nothing in these Terms limits nonwaivable consumer rights.

16. Limitation of liability

To the fullest extent permitted by law, Linked Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, or goodwill, arising from PolishTutor. Linked Labs' total liability for claims relating to PolishTutor will not exceed the greater of the amount you paid for PolishTutor during the 12 months before the event giving rise to the claim or US $50.

Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that mandatory consumer law in your place of residence continues to apply. Any dispute that is not subject to a mandatory consumer forum will be brought in the state or federal courts located in Delaware, and you and Linked Labs consent to their jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Changes to these Terms

We may update these Terms. We will update the date above and provide additional notice when required. Continued use after updated Terms take effect means you accept them, to the extent permitted by law.
